Credit Gathering Authorization

By agreeing to this Credit Gathering Authorization, you represent that you are authorized to act on behalf of yourself and the business entity applying for financing (collectively, the “Applicant”). You authorize Upwise Capital, LLC, including its representatives, affiliates, and subsidiaries (collectively, “Upwise”), as well as the third-party lenders, finance companies, and other financing partners participating with Upwise (collectively, “Funding Partners”), to review and obtain information about your personal and business credit profile for the purposes of processing the Applicant’s request for credit or financing.

Authorization to Obtain Credit and Financial Information

You authorize Upwise and its Funding Partners to conduct any credit inquiries or investigations they deem appropriate about you and your business. This includes obtaining consumer credit reports and business credit reports from credit reporting agencies. You also authorize Upwise and Funding Partners to request and receive financial information from other third parties, including banks, creditors, and financial institutions, about you and your business.

You further authorize Upwise and its Funding Partners to obtain updated credit reports on you at various stages of the financing process, including: during the initial review of your application, again at the time of underwriting or closing of any credit or financing product offered to the Applicant, and at any time during the term of the financing (for purposes of account maintenance, servicing, or collection). This authorization is intended to serve as “written instructions” in accordance with the Fair Credit Reporting Act (FCRA), permitting Upwise and its Funding Partners to obtain your personal and business credit reports as described. You also authorize Upwise and each Funding Partner to contact third parties (such as creditors or landlords) to verify information contained in any credit report or any other information you have provided in connection with your application.

Applicant’s Certification of Information

You certify that all information and documentation you submit to Upwise (or directly to any Funding Partner) as part of the application—now or in the future—is true, accurate, and complete. You understand that Upwise and Funding Partners will rely on the information you provide when evaluating the Applicant’s request for financing. Any misrepresentation or false statement made by you in the application process may be considered fraud. Upwise, the Funding Partners, and any relevant authorities may pursue legal remedies against the Applicant or you personally if any material misrepresentation is discovered.
